Please remember the prison sentence given was for withholding the password.

The police in England and Wales have the power to demand the password to access your phone, laptop or any other electronic device. If you refuse to hand over this information then you could be committing a criminal offence.

The law which allows the police (or other authorities) to do this is the controversial Regulation of Investigatory Powers Act 2000 (RIPA). S.49 is the relevant section which came into force in 2007.

The police are able to request disclosure if the reason is to prevent or detect crime, if it’s in the interests of national security or if it is in the interests of the economic wellbeing of the UK. This definition can be applied very widely to the extent that it can cover any crime, no matter how minor.

If the Police demanded the password for this website and you refused?

Refusal to comply with a notice served under s49 of RIPA can result in a maximum sentence of two years imprisonment, or five years in cases involving national security or child indecency.
 
I can't help but think I'd take the hit on the cannabis offences if I thought it would get me off the murder charges (assuming I was innocent of course).

I can see why some would see it as an infringement but I think for the 'greater good' (think Hot fuzz :lol: ) then for serious offencces like murder, they should take priority over an individual's embarrassment etc over facebook or their porn stash or whatever.
 
They could have my password, after all this is an open forum and anybody can read your posts.

Given the amount of your personal data that is held by many 'powers that be' giving out your social media passwords is neither here nor there. If you refuse so as to conceal some sort of criminal involvement then tough tit its off to the nick.

Does that include all PM's that you may/may not have sent they would not be open for all to see
 
Nothing in my PMs/email/social media comments I make are a problem for anybody so yes, the Police can have my password and are welcome to read them. All to often on forums you'll see 'Its against my rights' et al, as a society we are changing into a me me me culture which is bad, people need to have accountability in their lives and not the unconditional support dished out on forums by someone they don't know.

Social media these days is not...very social.

If your PM's are (for example) encouraging others to break the law or are overtly racist or the like then I've no problem with the police being able to see them if its part of an ongoing investigation.If its part of a serious crime like murder then they should definitely be able to read your social media, they'd read your diary if you kept one. I don't do facebook/twitter but obviously engage in forums and I don't think I've posted anything anywhere that would get me into any trouble. If there was I'd hope that I had the courage of my convictions and defend what I've written, or at least explain if there was something that could be misinterpreted.
 
If you have nothing to hide, you have nothing to fear. I would willing give my details to the authorities if requested. If you start hiding stuff or acting shifty its when they start digging deeper. Comply and get it over with.
Can't do the time don't do the crime. Fair enough imho.
 
I wouldn’t mind the police having a look at my personal stuff....but there better be a dam good reason for it......in the article above would justify a dam good reason imo. However If the lad in question did not commit the murder but information and layout of his personal details suggests he did then that runs its own argument....innocent people have been jailed for less. The question then. Is! What would you do ? .

While i agree with most points my big problem is that the police do NOT need a search warrant to do so , they request passwords you say yes/no if you say no then yo can be charged, do we not "police by consent" in this country!, consent has been refused but still be charged. To do a search on your premises they need a warrant this would include your paper mail.

Also some computers and sites use biometric logins (fingerprint, eye retina) and they can "force" you to unlock devices
 
Policing by consent is the biggest crock of poo to ever become a legal myth...it more like "policing is ok as long as it's happening to someone else" or "policing? What bloody policing, they show up two days late and just give me a crime number!"
However absolute freedom to do whatever you want to whom ever you wish in absolute privacy is an idea that is too terrible to contemplate, we need to feel society looking over our shoulders to keep us on the strait and narrow...or is that just me? :evileye:
